Workers Compensation Fee Schedule: I met with Sen. Dave Schatz’s chief of staff on Thursday regarding SB 763, a bill Schatz pre-filed that would require the Division of Workers Compensation to establish a medical fee schedule with a maximum amount for various procedures. This would repeal the current law that allows providers to charge a fee that is not “greater than the usual and customary” fee the provider would receive from private individuals or private health insurance carriers. Schatz’s chief of staff said they received the bill from a law firm in their district who specializes in workers compensation, and that they encouraged us to talk to our national association and see what is working in other states. He also acknowledged that they don’t’ want to do anything that will drive physicians to stop taking workers comp patients. Missouri is currently one of six states that does not have a workers compensation medical fee schedule. Note that Schatz consistently files workers compensation related legislation, so this is not unusual for him to consider this type of legislation. Link to bill.
Feedback: Please send me any information you are able to share regarding the amount of workers compensation your ASC does and why this is problematic for your center. I just want to have solid talking points that can also translate to patient care.
Other states: Are there any states that have a workers compensation fee schedule that work relatively well for ASCs? In other words, is there a version of this we can compromise on to reflect another state’s law, or is our only path to try and defeat this legislation?
Rehder PDMP: Despite her previous comments that she would not file a PDMP bill, Rep. Holly Rehder (R-Sikeston) pre-filed her PDMP bill again (link to bill). This still does not change our prediction that it will be tough to advance a statewide PDMP through the Senate this year given that it is Sen. Rob Schaaf’s last year in the Senate.
Birthing Centers: Rep. Steve Helms (R-Springfield) introduced HB 1589 last week, which would exempt birthing centers from having to employ a physician with hospital admitting privileges. Under current law, birthing centers are licensed as ambulatory surgical centers and state law requires all ASCs and birthing centers to have a “current working agreement with at least one licensed hospital in the community in which the ambulatory surgical center is located, guaranteeing the transfer and admittance of patients for emergency treatment whenever necessary.” It’s unclear who prompted Helms to file this legislation, but it is worth tracking closely given that Helms is Vice-Chair of the Professional Registration & Licensing Committee.
